G8RTech^TM, LLC (“G8RTech”), warrants that the G8RSkin^TM balaclava, when used, handled, maintained, and worn strictly in accordance with the included use and care instructions, will be substantially free from defects in material and workmanship for a period of three months from the purchase date. Products returned to G8RTech and confirmed by us to be defective during the limited warranty period will be repaired, replaced, or refunded at G8RTech’s option.

THIS STATES G8RTECH’S SOLE OBLIGATION, AND THE USER’S EXCLUSIVE REMEDY RELATED TO THE G8RSKIN^TM BALACLAVA. THIS REMEDY IS NOT AVAILABLE FOR LOSS OR DAMAGE CAUSED BY ALTERATION, MISUSE, MISHANDLING, OR ACCIDENT. G8RTECH DOES NOT WARRANT OR GIVE ANY ASSURANCES THAT THE G8RSKIN^TM BALACLAVA WILL PROTECT AGAINST ALL OR ANY INJURIES, OR WILL DIMINISH THE TYPE OR SEVERITY OF INJURIES BY ANY DEGREE. EXCEPT FOR THE LIMITED WARRANTY DESCRIBED ABOVE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, G8RTECH EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. EXCEPT FOR THE EXCLUSIVE REMEDY ABOVE, AND EXCEPT TO THE EXTENT PROHIBITED BY LAW, G8RTECH IS NOT LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES THAT ARISE FROM OR RELATE TO ITS PRODUCTS, REGARDLESS OF THE LEGAL OR EQUITABLE THEORY ASSERTED, INCLUDING, BUT NOT LIMITED TO, WARRANTY, CONTRACT, NEGLIGENCE, FRAUD, STRICT LIABILITY.

The information regarding the G8RSkin^TM balaclava’s protective benefits represent data obtained from third party laboratory testing of pre-production prototype units, and not from field testing of the final product on actual users. This information does not give assurance of any level of performance, protection, or benefit offered by the G8RSkin^TM balaclava. G8RTech does not represent or warrant that the information is complete, accurate, or current, and reserves the right to delete, update, and modify such information at any time without prior notice.

No impact protection system can protect a user from all injuries. In all events the user assumes all risks, including all risks of bodily injury, death, and loss of or damage to property, arising from the user’s participation in athletic, recreational and any other activities while wearing the G8RSkin^TM balaclava. The G8RSkin^TM balaclava is not a substitute for and must not replace the protective gear, such as helmets, shoulder pads, and restraints, associated with the specific activity engaged in by the user. The G8RSkin^TM balaclava is intended to supplement and to be used in conjunction with standard protective gear.

To maximize the benefits of the G8RSkin^TM balaclava, proper fit and care of the G8RSkin^TM balaclava in combination with other standard protective gear are essential. This includes proper wearing and securing of the correct size of G8RSkin^TM balaclava on the head and shoulders, washing the G8RSkin^TM balaclava in cold water only using a mild detergent without bleach, and air or tumble drying at temperatures below 120°F (48.9°C). Do not expose the G8RSkin^TM balaclava to temperatures above 120°F (48.9°C) or below -25°F (-31.6°C). Users are advised to read and follow all of the other important instructions contained with the product. Warning: failure to abide by the instructions provided with the G8RSkin^TM balaclava could reduce the performance of the product and void the limited product warranty.
